Welcome to Habitchat! These Terms of Service ("Terms") govern your use of our WhatsApp-based habit tracking service operated by Habitchat ("we," "us," or "our"), based in Thurgau, Switzerland. By using Habitchat, you agree to these Terms.

Service Operator

Habitchat is operated from Thurgau, Switzerland. While our company is based in Switzerland, we use a US-based WhatsApp number to provide our service globally and ensure convenient communication for users worldwide.

1. Acceptance of Terms

By accessing or using Habitchat, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our service.

2. Description of Service

Habitchat is a habit tracking service that operates through WhatsApp. We send you daily reminders to track your habits and help you build streaks and maintain consistency.

3. Account Registration

To use Habitchat, you must:

• Provide a valid email address and WhatsApp phone number
• Be at least 13 years of age
• Provide accurate and complete information
• Maintain the security of your account

4. Subscription and Payments

Habitchat offers two paid subscription plans:

• Pro Plan: Track up to 5 habits with 30 messages/day limit. $2.99/month (early bird $1.99/month) or $19.99/year
• Ultra Plan: Track up to 15 habits with unlimited messages. $4.99/month or $39.99/year

All new subscriptions include a 3-day free trial. All payments are processed securely through Stripe. Prices are subject to change, but existing subscribers will be notified in advance of any price changes.

5. Message-Based Billing & No Refunds

IMPORTANT: Habitchat charges for WhatsApp messages sent to and from your account. Due to the nature of our service:

• NO REFUNDS will be provided for any subscription fees, partial periods, or unused messages
• Each message sent or received incurs a cost to us via WhatsApp/Twilio
• Message limits apply to prevent excessive usage and costs
• You are responsible for managing your message usage within your plan limits
• Exceeding message limits may result in service suspension until the next billing period

By subscribing, you acknowledge and agree to this no-refund policy.

6. Free Trial

New users receive a 3-day free trial. During the trial:

• You have full access to your chosen plan's features
• You can cancel anytime during the trial without being charged
• If you don't cancel, you'll be automatically charged at the end of the trial period
• No credit card required to start the trial (waitlist members only)

7. Early Bird Pricing

Users who join during our early bird pricing period ($1.99/month for Pro) will have their discounted rate locked in for as long as their subscription remains active. If you cancel and later resubscribe, early bird pricing may no longer be available.

8. Cancellation Policy

You may cancel your subscription at any time. Upon cancellation:

• You will retain access until the end of your current billing period
• No refunds will be provided for the current billing period
• Your habit data will be retained for 30 days after cancellation
• You can reactivate your account within 30 days without losing data

9. Acceptable Use

You agree not to:

• Use the service for any illegal purposes
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Send spam or unsolicited messages through our service
• Impersonate others or provide false information

10. Intellectual Property

All content, features, and functionality of Habitchat are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

11. Limitation of Liability

Habitchat is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.

12. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue the service at any time with reasonable notice.

13. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the service. Continued use after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by applicable laws, without regard to conflict of law principles.
